Arista Networks Ltd v. Alliant Techsystems, Inc.

Appeal from a judgment of the Federal Circuit.

Donoghue, Jr.

Senior Judge.

The appellant, Arista Networks Ltd. , appeals a final judgment of the Federal Circuit that dismissed Arista’s complaint in a lawsuit alleging infringement of rights of an international business network. See Arista Networks Ltd. Alliant Techsystems, Inc. 3d 1301 (Fed.

Arista was once a subsidiary of a global organization of multinational companies and their subsidiaries. In May 2003, the parent company, Arista, acquired an affiliate company, Alliant, in an agreement in which Arista paid $24. 5 million to Alliant for the purchase. The acquisition was not the result of the parent company’s formal acquisition of Alliant. In December 2003, the parent company dissolved, and Alliant’s parent company took over control of Alliant’s assets. Alliant changed its name to Alliant Techsystems, Inc. (Alliant), and in 2006 it filed for bankruptcy. The bankruptcy court authorized a trustee to serve subpoenas on Arista, requesting that it turn over various documents. The trustee served the subpoenas on Arista and on Alliant itself, and in an eight-count complaint Arista claimed copyright ownership of the documents. Arista claimed the documents covered the assets of at least nine companies, including Alliant, and that it was entitled to those assets. Arista further moved for summary judgment that it was entitled to the documents and an award of costs and reasonable attorney’s fees under the Digital Millennium Copyright Act (DMCA), 17 U. In August 2008, Arista was awarded summary judgment and costs, but the district court denied Arista’s motion for attorney’s fees.
