There are several answers to this question.

This is an important question, because it is unlikely that the copyright laws themselves were meant to be abused in ways that put educators (or students) in the position of infringing upon the rights of the publishers and creators of educational software. What is more likely to happen is that existing copyright law is used to justify the possibility of infringement (as in the question about the educational use of video games).

One response would be to argue that it is possible to have some good reason for copyright law to be used to protect copyright infringement.

Video games are a diverse, complex and very interactive field. Although many video games have positive impacts on youth in the developed countries, the problem of intellectual property rights have emerged increasingly in the last years. This article examines the current situation and the legal requirements that are needed when games are made available in Europe.

Today in general, intellectual property rights are not properly recognized by both law enforcement agencies and copyright holders in connection with games and software. The Copyright and the Patent Law are the two main legal bodies that shape intellectual property rights in games.

International law does not recognize intellectual property rights in connection with games and software. On the other hand, in general, copyright holders only have rights in games that are created in the public domain, which means games that can be freely distributed and played without restriction. Because the creators of many games have received positive feedback from their users, copyright owners feel that these games have already been created in the public domain, so that it is technically impossible for publishers or developers to create original games. The creators of such games feel that, since they already have created a valuable product, they are unable to create new products in the public domain. The copyright holders need the support of the state authorities to force the publishers or developers to publish their games.

Copyright and other law, including the Copyright Law, the Patent Law and the Trademark Law, is based on the idea that, in order to obtain a valid copyright, the creator has to create original works. The Copyright Law, the Patent Law and the Trademark Law is based on the concept that intellectual property rights are created by people who write down their ideas.
