We would recommend that the terms of the SBA license be interpreted broadly to mean to include all customers, not just those with high-demand satellite capacity, in the terms of the license unless SBA agrees otherwise. For example, the terms of a license with no customer exclusivity are interpreted broadly to include all customers, even if the license is restricted to one customer.

Satellite-Based Broadband Inc. (SBA) is a provider of satellite broadband infrastructure for the U. and elsewhere as well as a direct offering of broadband service in the United States. The FCC’s jurisdiction includes the U. Virgin Islands, Guam, Puerto Rico, the U. Virgin Islands, and the Commonwealth of the Northern Mariana Islands.

[3] Improve the resilience of the satellite fleet through the acquisition of additional capacity to accommodate increased network congestion and the addition of new spectrum where appropriate.
