Following the charges against him, Faiz spent many years as a foreign soldier in the US military. One of the things US President George W. Bush’s administration is accused of is that it did not notify the Taliban about Faiz’s status as an enemy combatant. The Taliban were aware that Faiz was a Westerner whose family had roots in Afghanistan, as well as a former Taliban member.

When Mullah Omar was ousted from the Taliban leadership, Faiz was reportedly appointed the leader of the Taliban. Faiz has denied the Taliban claims of having any role in the killing of civilians. Faiz has stated that the military commanders who were accused of the murder of people at Khunjerab prison were selected by the intelligence officers, but were able to escape death with their lives.
