Public consultation is intended be a method of soliciting feedback on a draft proposal or draft regulations before a final decision is made on them.

The process of public consultation, or the “public hearing”, includes public participation, which includes questions in an open-ended manner and in an understandable manner, and also involvement of the public in the process.

Public consultation is an important aspect of the ongoing process of regulatory drafting. This is a major reason why many regulations are drafted in a public-forum and that is why it is often better to have public consultation in advance than to have a draft regulation sent to the public, when it is still in committee of the administrative body, after they have agreed through the public process that it is acceptable to send it to the public.

It is important that the public hears about the proposed rule and that they have a voice in determining what changes are proposed. Many of the concerns expressed by the public during the public process will have an effect on the final regulation. By letting the feedback of the public be heard, it is also the responsibility of the Department to do what is right and best for the regulated persons and businesses.

An open-ended public process, in which the government is free to ask the public questions, is the goal of any public process. If it is not done successfully, the regulations will not be effective. In the beginning, and especially before it is done, it is important to be open and transparent. To do this, the public is entitled to be aware of the changes in the draft regulations proposed by the Department.
