The only way for South Dakota to legalize cannabis is to also legalize medical cannabis. A bill that would have allowed doctors to prescribe medical cannabis to patients who could not otherwise buy it from a pharmacy or dispensary has now been passed by the Legislature. The bill cleared the House on a 75 to 25 vote last night, along with support of eight Democrats and five Republicans.

Senator Jeff Danielson, one of the two Republican sponsors, said that it is time for South Dakota to move forward with the full legalization of marijuana for adults. According to a statement from the legislative office of Senator Danielson, “This bill represents the right direction for marijuana in South Dakota. I am proud to have worked together with the South Dakota legislature to support medical marijuana and I look forward to working with the governor and other legislators throughout the state to achieve full legalization.

The bill now goes to the Senate for consideration. It will have to be debated prior to it moving into effect.

South Dakota is currently the only state in the country that does not have a medical cannabis program. This is a major blow to people who have tried to get their medical cannabis from a dispensary or pharmacy in the past. If the bill is not passed, it could prove to be another major setback for medical cannabis in the state of South Dakota.

In 2017, Governor Kristi Noem signed a law allowing local authorities, schools, and universities in the state to provide medical cannabis to students, teachers, and employees.

This bill is the first such request by a governor to the Legislature and was signed into law by Noem on May 17, 2019.

The state is also exploring the possibility of a cannabis store to be operated by a private business owned by a school district. The proposal is being considered by school districts in each of the six county boards.

South Dakota’s 2018 cannabis law decriminalized cannabis possession and cultivation, but did not legalize cannabis sales.
